| Newark airport: Beware | ||||||||||||
|
Anyone planning to enter the
United States with an H1B
visa through Newark airport
needs to rethink that
decision. Within the last
two weeks, CBP officials
there have been routinely
stopping and turning around
valid H1B nonimmigrants. Not
all, by any means, but many.
The stated grounds for their
refusals are bizarre, to say
the least. For example, in
one case, they said that the
individual's H petition was
invalid because the job
involved work for a state
agency. "Only US citizens
and green card holders can
work for state agencies"
claimed the CBP supervisor.
This is, of course, utter
nonsense.

H1B Quota Reached |
On December 21, 2009 the USCIS announced that it had received sufficient H1B petitions to fill the fiscal
year 2010 quota. All petitions accepted prior to December 20. 2009 will be accepted and processed normally.
USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap
and were received on December 21, 2009. No new petitions that are subject to the cap will be accepted for
processing. |

USCIS Data Mining |
The USCIS
is actively engaged in mining
data from its own records, as
well of those of other federal
agencies and some private
databases. The extent of the
data developed is genuinely
amazing. A recent response to a
Privacy Act Information request
filed by an attorney revealed
that DHS records on him
included his airline seat
preferences, travel agencies
used, credit card information,
and other very similar items of
information that appear to have
no relevancy to national
security or any legitimate
government interest. |

| Required Supporting Documents: Birth Records |
|
A certificate of birth is required for all individuals applying for classification as a lawful permanent resident or seeking to file a relative petition. In some instances, applicants and petitioners do not have official birth records. This could be due to several reasons. For example, the record could have been destroyed in a fire or civil disturbance. It is also possible that the applicant or petitioner’s birth was never recorded. |
